I have a couple of questions, pl let know if you have valid info.
Situation: Spouse came to US on H4 and then got converted to H1.Due to delay in pay and not a strong case, she is not willing to go for H1 visa stamping next time when she goes to India. She wasnts to go for H4 visa stamping instead.
1. Is it better to convert to H4 here and then leave for India? We feel that if it would take time to convert to H4, then instead of waiting she can work till the last day here and then quit and leave(because she wants to leave ASAP). Also changing from H1 to H4 here means submitting paystubs and other documents and more scrutiny. I think in Chennai consulate there will be less questions if applying for H4. Any thoughts, pl help?
2. If applying for H4 in Chennai, will they ask for paystubs from her previous H1 status? They shouldnt since she is applying for H4, but I still wanted to know. If they ask why do you want to change back to H4, what is the best answer?

Section 11 has been created for you to tell them abt last EAD APPLICATION.

My parents are getting old. I am going back in 3 years. Heard from friends, earn enough and go. There will never be enough.
Almost, all of us started here from Nothing. Now we have atleast something to start with. Yes there is always things for Pros and Cons.
I am not worried about GC. Waiting for a good opportunity to jump back to India.
It will be really nice if I can get work from home job from US and settle down in a hill side with nice estate in India. :cool:

i do wonder if the poll results from earlier polls if used to compare with the current one would help get an idea of the trend - kind of overlaying the snapshots in different points in time and then determining what the situation was and what is and then extrapolating based on data that is already known/ published by uscis applied to the trend. question is if we have the poll data from earlier polls?

Hopefully from October 2010 the date stay as it is. Did you checked the cut off data it does show 0 requirement prior to 2006.
Very Disappointment for me.....as i missed it with couple of days.

they dont get any certification or any skills but however they want all the benefits/promotion..etc.
In such situation...dont let the situatuion grow..you need to change your gruop/company and remind the manager that they need to stick to rules..be diplomatic.If you are diplomatic and sensible in dealing with such cases..you will come out a winner..
Dont forget to complain to the HR about this person ...as this is a recurring pattern...then they will have a record of the persons behaviour

Best way to get more immigrants to participate in advocacy efforts by immigrationvoice.org for legal immigration is by communicating to international student organizations of various universities around virginia, maryland, washingtondc,west virginia north and south carolina. Arranging busses for the students is not a bad idea. I can understand the emotion and commotion among my fellow beings who are stuck with BECs. I waited agonizing 5 years to get my labor cleared. We all clearly understand what are you guys going through.
But the thing is that Labor Certification issues are taken care with PERM implementation. Also the administration set up 2 BECs to take care of them back logs. Now the issue is purely administrative and not law making. Also BECs made it clear that by Oct 2007 all the back logs will be cleared.
Right now big things are happening in the immigration law making. So I think we should concentrate to get the best out of it and achieve our goals on the Green Card Visa issues. As Tom Tancredo is going to fight with teeth and nail against Immi Bills, we have to do the same.
There are many others issues we can lobby for such as
1) Starting H1B stamping inside the US again( Which was stopped in 2005)
2) Allow H1B spouses to work. etc etc
But I believe our priority for the time being should be Retrogression. I request all of you to use this thread for finding a person to testify.

If indeed the majority at IV believe that BEC is not a problem, then it would not be a stated goal of IV. Let me repeat, so long as it is listed as a goal, it is the moral responsibility of all of to support and work towards resolving the issue.
This is important. Don't just pretend to support IV and play down what matters to others. Your must support all the goals we have at IV and not pick and choose what you like.

USCIS issues Employment Authorization Documents (EAD) in the following categories:
EAD: This document proves you are allowed to work in the United States.
Renewal EAD: You should apply for a renewal EAD six months before your original EAD expires.

However, if your application takes more than 90 days you can go to them and they will send an email to USCIS and you should then receive one within two to three weeks. I was told that calling the 1 800 uscis number and following up when things have gone beyond 90 days should have the same effect.
I am more than a little skeptical that this would work out. Have yet to find out since my spouse's EAD has only been pending for five weeks at this point.

You are not the only one....my application was also sent on July 2nd and I got FP notices (both my wife and I) and AP approved (both my wife and I).
My wife received EAD on 10/22 and so far there has been absolutely no update on my LUD and EAD application is still pending. The service center is Nebraska and I am the primary applicant. I think there a a lot of people in the same boat.
I'm on the same boat and I scheduled an INFOPASS apt and she asked me about biometrics for my I765 and I showed the receipt which I have done for my I485. She immediately responded saying is was for I485 and you need to do one for I765 and then your EAD card will be approved. My bio is scheduled for 01/26.

I think what Godbless bought was Universal Life Insurance policy where the Company invests in Mutual funds etc. but that has lots of finance charges and hidden costs. Traditional Whole Life on the other hand has no such thing because by law the company can only buy bonds, govt securities and Mortgages only. Hence the return on Traditional Whole Life policies is low (5-6%) but they are safe and do not have hidden charges and infact insure you at a fixed cost for whole life hence the premium never changes and policy cost to the insured remains fixed while the cash value is an added incentive for the long term. It's like putting money in bank and earning some interest but having a life coverage at the same time for not just 20-30 yrs but uptil 98 years of age. I have a few family members who are insurance agents and they always recommend Traditional Whole Life if you have good income and patience to stay long. For all other folks Term is the best but note that when you retire at 60+ and have built immovable assets then to cover the risk for them you need to have some Life insurance policy and getting Term at that age is like walking on fire. Nobody gives Term after 65+ and even if they do so then the premium is very very hefty which can be a good turnoff.
So, it all depends on your priorities and situation. 95% of US Citizens / PRs with above average asset values & income buy Traditional Whole Life policy because they are living longer and working longer and building assets well into their 60+. Term provides good & cheap coverage for young people but only for max 30 years period. After 60 + people are in soup again without Traditional Whole Life coverage.

Me too in the same boat. I have EFiled EAD renewal on May 21st and a LUD on July 31st due to my address change. No idea how long should I wait. Thouht of taking info pass but looks like one of the option is saying "if EAD pending more than 90 days" So I should wait another 5 days before I take an info pass. I am planning to take the recent USCIS memo where it talks about interim EAD and see what they say about it.

Bingo! I was about to say this -- Under COBRA, govt will pay 65% of the payment. I have been to this boat before and COBRA is extremely expensive (~1500 dollars a month for a family of 3).
Also, you need to talk to a lawyer! Desi companies....what can I say.... no company should terminate anyone in the 9th month of pregnancy.
Status wise both you and your husband are OK. Just make sure that both of you renew AP and EAD on time.

As part of stimulus plan, you need to only pay one-third of the actual COBRA payment and you can avail this benefit for upto 9 months. In case you end up using it, this is a significant saving on your health insurance.
