yes, its an equally plausible statement; however I was only referring to the way USCIS handled the July 2007 fiasco applications. There will always be bit of exceptions here and there. As people have pointed out also, there might be reasons for those exceptions as well. They have various stages in processing a 485 application, so it'll not always be FIFO. There'll be a bit of overlap always.

Average fee hike is $500 but average reimbursement of expenses would be atleast $1000
As per various lawyers' web-sites -- It is highly unlikely that there will be reimbursement of expenses even if case is won.

I think there is a need to educate politicians that the problem is not H1B but GC backlogs. As per USCIS only 7100 H1B's have been utilized so far for FY 2012. Unless they provide clear and time bound path to Permanent Residence, positive economic contributions from high skilled immigrants would be minimal.

I do not know what level of education you have achieved so far in your life but it looks like you are not enough educated to differentiate between the definitions of permanent residency, citizenship and perhaps working on work visa as far as legal stay in USA by outsider is concerned.
What would be the "legal" reply from US Supreme court,if you ask US supreme court that whether citizen of other country can call US president a "My president"? . And What would be the "legal" reply from Supreme court of country A,if you ask that whether citizen of country A can call US president a "his/her president"?

Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. And I do not know about other countries but in India it is not considered "illegal" and/or "unpatriotic" to go in other country(Except Pakistan and Bangladesh) for legal work so coming to USA for legal work whether on work visa or becoming a permanent resident in USA while maintaining Indian citizenship simultaneously is not unpatriotic or illegal. Yes, the same software was used that readily available in the interest of time. This website came up in the last week of December and we are improving it everyday as much as we can.
We have our own admin who is actually a volunteer of immigration voice. Most members here are members of immigration portal that joined hands after failure of regtrogression provisions in S 1932 on Dec 21.

What is your take on all these bills.. I am sure you have much more info. Do you see any hope of EB relief in 2009?
There is growing pessimism in EB community.
We have some rough plans for 2009.
We need to wait for some time to see how immigration bill becomes a priority. We anticipate some more placeholder bills that will make a statement. However in the end, there will have to be a bi-partisan effort and strong will to write a CIR. I feel economy will take priority initially but they will have to look at immigration sooner than later. Admin fixes is another possibility we see. While the EB2 India and China are now getting direct benefit from horizontal spillovers, in 2009 we need to meet again with the administration and make a good case about EB3 India, China and EB3ROW backlogs. The problem seems to be increasing due to limited visas per year. This is the reason dates have not been moving. Several Other small items for admin fixes are also in brainstorming stage. Like We want to address processing delays on all applications for all categories, do something to protect the rights of immigrants, etc.
We also want to involve more members who got their greencards or immigrants who are now citizens on IV. We want suggestions from members how we can do that and get their support for this cause.
I am sure with the new initiatives you will love Immigrationvoice more and want to come to IV everyday.
At your end, please try to spread the word about IV. We can be successful in all our initiatives only if we can get more participation. Thus we need to get more EB India, china and ROW members in the IV fold. This must be our top priority early this year before we launch our big campaigns.
We look to members reading this post to help us reach out to their friends and introduce IV to them. We have well meaning intentions for everyone in every category and country and want to help and bring relief. It is important that we come together on IV and make a united effort to end our common immigration problems.

if you take your h1 renewal reciept they are suppose to give an interim date. I had the same problem in Columbus, OH.
H1 expired awaiting h1 renewal for 3 years (as I40 approved). First they denied. then i politley asked the DMV guy if he could drop me and pick me up and my wife from work everyday.
he asked me to get the renewal notice, letter from employee and intent to work further with the employee.
they gave me a 6 months dirvers licence.
and believe me, i dont think DMV guys know any happenings that impacts h1 guys. its the citizen law or illegal immigrant law and we get caught in the cross fire.
next time give them the immigrationvoice.ORG URL and ask them to educate themselves.

not a single person has explicity voted "No". And again, you havent defined "more". Currently, I believe the contribution limit is 25 dollars per month. When you say more - what number are you thinking of. And now look at the folks who said YES. What numbers are they looking at. If you had put in a number and said "are you willing to pay x dollars per month .." - then you can be assured of that the members who say YES are on the same page as you. Right now, what you have is a number of folks but they may not be on same page.
And what is the definition of "updates" ? We are not working here on a fixed time project where the deliverable is due at the end of period 'x'. For quite a lot of period, the updates will be generic and on the lines of "we are working on getting to our goals and we are making progress". You will not get any more details than this. Turn around and check with the folks who said YES -- is this what they are expecting. Or they are expecting something different.

I dont know the exact number but have a strong feeling that this number will probably in the 10-15 percentile only. And guests is not equal to an unregistered IV member. There are a lot of people who just browse the forums and dont post - they dont need to login everytime they come on to this site - therefore you will see a good chunk of visitors but they necessarily are not unregistered members.

My Above mentioned EAD is approved today. I got the Card ordered mail from CRIS today at 7 pm...
My Wife's EAD e-filed same date as mine on May 28th is approved today. I got a Card Production ordered mail just now. MIne was approved yesterday.
There was just 12 numbers difference in Receipt nos.
Looks like they picked up speed as they reach the 90 day mark....

Hi,
I have 3 yrs degree + 1 yr PG diploma. I have been working in industry for past 17 years, and don't think any degree or even doctorate would add much to my qualification for the job that I am doing.
I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. I have no idea how it works, what qualifies me for a degree, what can I get credits for. Any inputs would be appreciated.
