Pal, don't try to be selfish and narrow minded here. Step into PBEC victim shoes and then we shall see what language you speak.
Opportunity to speak in front of congress won't come everyday. So we should highlight all the problems faced by us during the employment based immigration process -- whether it is rotting in the PBEC mess for labor certification for 3-5 years or for visa numbers. They all should be brought forward.
The deadlines don't mean any thing but the results in hand do. If it were resources issue, then DBEC would also have been also stuck somewhere with 2001-02 cases but no.. they are processing 2004-05 cases. There is something seriously wrong with PBEC and needs to be fixed.
Again with all due respect, I was trying to make sure we concentrate on whats on table in the next two weeks, which may never come to the table again in a long time. But if I sounded indifferent to the BEC issues, my apologies.
I am a BEC victim too from April 2001. I have been waiting to get my Labor Certification from April of 2001. Till date, I know it may be in one of the BECs if it wasn't lost in transit. I was not able to obtain a screen shot nor do I have a 45 day letter. Still I say, when setting priorities, set it on what can be accomplished in the next two weeks, I agree with you in using the IVs opportunity to speak to bring all issues.

This is unprecedented - NSC was doing Eb3 140's slowly and now they stopped.
NSC EB2 140 is July 5th 2007 (my friend got approval yesterday by filing in Aug 2007)
Clear your cache and then reopen browser - you should be able to see MAY 15th update.

It seems online status for my FOIA request has not been updated since Jan 15th. Is anyone also facing the same issue? BTW, how long does it take to get it once online status changes to processed.

no you dont *need* an accountant... but accounting is a lot of work and if you do not understand the law and the IRS, then you could get into trouble with bad accounting...

Recently, I stopped taking all these racial comments in a serious way, 2 days back my co worker made comments on how my "curry smells" when eat at my desk. My wife wakes up early in the morning and cooks the food with so much love and affection and I eat that, whereas he eats burgers and fries from cafeteria - look at who is commenting??????
I can understand the love your wife has for you. But I think you should enjoy that lovely lunch at a cafeteria. Smells can be very offensive. I love Indian food, but if I had to smell the Indian food in my cube everyday I would be pissed too. There is nothing racist here. I would be pissed if your coworker eats a burger with raw onions and then talks to me with that smell.
This is one of the first things new Indian students are told: Smell (or lack of it) is very important in America. Don't reuse socks, Use deodorant and enjoy the curry at home.

Till 2007 that was how it was being interpretted and then suddenly DOS realised it should be by category and not by country of chargebility.
The earlier Eb1 ROW>Eb2 ROW>Eb3 ROW spillover is called vertical spillover
The current since 2008 spillover Eb1>Eb2>Eb3 regardless of country is called horizontal spillover.
However see in Horizontal spill over Eb2 India backlog takes of the numbers (14k in 2008)
In vertical spill over Eb3 India backlog takes the numbers(17k in 2007)

So either method wont help Eb3 ROW. Its a double whammy.

I have 3 yrs degree + 1 yr PG diploma. I have been working in industry for past 17 years, and don't think any degree or even doctorate would add much to my qualification for the job that I am doing.
I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. I have no idea how it works, what qualifies me for a degree, what can I get credits for. Any inputs would be appreciated.

Seems like your end goal is to get GC, have you considered option of waiting for your son to become 18 so that he can sponsor you for GC? That might be an even faster option than EB2, considering the current backlog.
This is of course assuming that your son is a US citizen.

Can anyone with some indepth knowledge predict availability for EB3 Rest of world (Canada). Here is some of what I understand - although I know it may be wrong (some infor from Shusterman site)....
- 300,000 applicants in BEC
- assume 200,000 get through
- assume 1/2 have a spouce and 1 child
- therefore need 400,000 visa numbers (Shusterman had 300K here, I think they are wrong??? - pls check my math)
- now most EB immigrants are from China & India (half?????) - restricted to 7% of the annual 140,000 EB visas annually
- all* applicants up to first half of 2002 are "gone" - *except for ones in BEC = how many????????????
- AND if rest of world is 200,000 people in line for 120,000 visas annually (140,000 - 7% China - 7% India)
- now people in line go from 2001 - mid 2005 in BEC??????; but very few 2001 & 2002s left????
- thus: rest of world with PD of March 2004 - should get visa availability within this fiscal year - e.g. by Oct 2007????

If my priority date is retrogressed at the time of processing my EAD and AP, will USCIS keep the EAD and AP on hold? Or will they process EAD and AP and hold the I485?
