    If LOA can stop the old employer from revoking I-140, I would say, go for it. But just make sure you don't land into any other trouble (like non-competent etc. just an example, may not be relevant in your case, but you get the idea...).
    Also, discuss with the new employer and make sure they are ok with supporting you in case of an RFE. From your response, looks like they might know what it is. What I can think of is, consult an attorney and discuss what kinda RFEs you can get that needs employer help (mostly EVL, ability to pay), prepare a sample response letter for both and check with the new employer they are ok with providing them if necessary.

    the new company has no clue about visa/h1/gc issues. they have never hired a "brown" guy and they do not even know that i am on ead..even if i told them they wouldn't know wht to make of it..so the only letters i can get will be generic letters stating my occupation and salary with a very brief description of duties. i know someone said loa is not a good idea but i think it just gives me a back up.

    There is no case if your wife says you did not hit her. Didn't find a desi attorney in CA.

    You said you are standing trial. At the trial if your wifes says you did not hit her or hurt her. What is the jury going to discus on. I think there is some thing missing here. They just do not want to waste time of the jurors on a simple thing. Your wife can meet the DA in person and request for dismissal.

    Btw, if the visa bulletin is not out yet, its a good omen. Over the years it has been observed that whenever visa bulletin comes out a bit late, like between 13-15 of a month, it moves the dates quite a bit forward. The bulletins that come out early in the month, like before 10th day of the month, truly sucks.

    Good point , but neither H1B says its only for INNOVATORS rather it says only SKILLED workers. Not even every PhD is innovator . May be in some circumstances the so said perspective is true but i dont agree with every point.

    There are no enough Americans who can do the Job if you guys think its H1B and remove H1B every Job will land as an outsourcing . If not h1B many Outsourcing IT firms will find some way to temp bring IT pros and eventually outsource.

    The Key point that IV is making is how much taxes we are paying and how good we are making to American economy. If they remove H1B ,then they understand how and what they have lost.

    Good points, only thing to add is not all innovations can be brought to notice to relate to a sinle employee ...most of the times we as employees are part of systemic effort that is innovating. It would be wrong to say that H1-bs are not contributing towards innovation anymore.

    FYI..might help you..My attorney is so tough on providing information to me, So I said that I need the alien # to file an online AR-11, the attorney did not refuse. :)

    Thanks for your reply.

    I really dont care what my company policy says because as I look at it, it should be my decision whether to work on EAD or continue on H1-B. If they switch my work authorization without my knowledge, then it will be a classic case for lawsuit. Moreoever the policy is not documented anywhere.

    As long as you dont use your EAD, you can continue working on H1B.

    In fact, if it is the same employer as your GC sponsor, you dont have to do anything.

    The thing to remember is to extend your H1B if you do a H1B transfer so you dont have any issues at the time of transfer.

    All this is assuming that your company policy can handle exceptions to the policy :)

    - MS+0 / No BS requirement

    I am not sure what you mean by this... I have a schedule which lays out the exact amount which is payable in case you terminate the policy before the end of the level term period... which is about $1K in the first five years and hardly anything in the initial years but increases at the end of the term period..that apart you can either pay lump sum premium annually or you can pay monthly�.

    Let me know if this helps� or be more specific so that I can check..

    I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?

    We need IV help in this area.

    The short answer is most republicans voted yes for the senator Cornyn's bill to recapture the unused employment -based visas from previous years and almost all Democrats voted No (except Murray democrat from Washington voted yes for the bill. I guess Microsoft does have influencial power on the senator from Washington state)

    (1) in paragraph (1)--


    (A) by inserting ``1994, 1996, 1997, 1998,'' after ``available in fiscal year'';
    (B) by striking ``or 2004'' and inserting ``2004, or 2006''; and
    (C) by striking ``be available'' and all that follows and inserting the following: ``be available only to--

    ``(A) employment-based immigrants under paragraphs (1), (2), and (3) of section 203(b) of the Immigration and Nationality Act (8 U.S.C. 1153(b));
    ``(B) the family members accompanying or following to join such employment-based immigrants under section 203(d) of such Act; and

    (2) by redesignating clause (vii) as clause (ix); and
    (3) by inserting after clause (vi) the following:

    ``(vii) 65,000 in each of fiscal years 2004 through 2007

    I can understand cases where dates are current. But how they decide on cases which might have "visas available in coming months"? Do they know beforehand the movement of dates for coming months? or does that mean they continue pre-adjudicating cases in an order (probably by Priority Date)?

    All the dates in all the chargeability areas will become current and USCIS will recogonize all the people as people and not files. They will also issue a huge apology for all the delays in the past.

    Dude, you forgot the most important point....

    After apology/providing GC, they are going to provide settlement assistance as a welcome gift....

    Hi, me and my wife we both r on H1b. My wife works with a solution & service LLC.say company A, now the owner is ready to start a new company, say B,with my wife as partner. She will be just passive investor in the company and getting profits, if any from company B. Can she still work full time with company A?. How can we invest in company B and take profits. What r IRS forms?. Finally any good attorney suggestions for Houston, TX.

    What are the options for business formation,

    Does anyone see any issue with this kind of formation and GC process for me.

    Probably you were busy with your GC and someone else was doing what your balls should do..

    We have 2 pages of posts, but just 150.00.

    Sanju is right when he says, we are High-tech educated illiterates.

    You have 15 posts. First you were crying for EAD, then GULTI, now all this.

    And you think this is the way for convincing law makers on our contributions to American society? Is it because of your bad language, the law makers should give your spouse, EAD?

    Seems like we missed a golden opportunity in this bill. Is this the must pass budget bill? or related to troops in Iraq? I am suprised to see that this went completely under radar. I will write to my senators to thank them for the support (though it failed its nice to see their support).
