EB2 - April 2004 (4 YEARS Between 1 & 2)
EB3 - November 2001 (2.5 YEARS Between 2 & 3)
Why there is so much diff between each category.

May be As a Hindu I'll start visualizing Shiva/Vishnu/brahma/Rama/Krishna etc.. when someone says "GOD" .For Christians they may start visualizing Jesus and Allah for Muslims.

Have you talked to lawyers with arguments you have mentioned here? Do you think there is a strong legal ground for success? For all five "questions" you have asked, there is legal backing. Law sees legal grounds, not sentiments, which seem to be the prime content of what you have stated.

Guys, lets not divide the community again. Everyone is suffering in their own ways due to backlogs. I know some EB2 folks who got GC, got a home and now their home price is way down.
If we complain about discrimination, we don't have a case. Look at EB3-I distribution between 2003 and 2008, inclusive.

In all the years listed above, visas allocated to EB3-I were higher than 7% country quota for India which is about 2803 visas. ( .07 * .286 * 140,000)

I read a few months ago that to avoid wastage of visa numbers USCIS is going to introduce one more date called a "Qualifying date" which would essentially mean that even though your PD is not current, you may apply for 485 because USCIS has the resources to process your application.
The last I heard they were going to introduce something after Sept/Oct this year. has anyone else read of any other updates anywhere?
Note: this date is not going to get you EAD/AP or green card. This is only meant for USCIS to maintain their workload efficiently. It may benefit people who are single and who have already applied for 485 by quelling their fears of their application getting approved before they can add their spouse.

Thanks Almond... your post summarizes exactly how ppl in my position feel. one of my frds did MBA from top 20 B-school but could not change to a new job in management career becoz his I-140 approved but did not file for I-485 yet and worse yet he crossed 6 year H1b. now he is also living on 3 year h-1b extensions with approved I-140. when he was venting his frustration like me, one a$$hole (GC holder) suggested he move back to his home country. funny thing was this a$$hole got her GC becoz she married some bakra who already applied for GC. within 6 months after she arrived in US, her huby got them GCs. This dumb wothless piece of $hit doesnt know how hard (impossible ?) to get GC in this lifetime becoz she got it in 6 months :mad: .

My PD is 2010 in EB2 and I came here in 2004. I know what I'm getting into and it's my decision so I won't fret about it or get depressed. Cornyn's amendment is "general legislation" seeking to amend an "appropriations bill". To be able to vote on Cornyn's amendment, 60 Senators have to vote to waive Rule No. 4. Only then can the senate vote on Cornyn's "general legislation".
Sorry to flog a dead horse but the Dems should not be blamed; if they had voted to waive the Rule, then all sorts of general amendments would have been offered by others and tough to cast aside.
On the other hand, it is useful to know that more than a handful repubs support this amendment; this could be handy in an actual vote when Sessions or his ilk seeks to filibuster the amendment. We may have 60 votes to win cloture.

The reason why most people end up with such situations is that the employers don�t file for H1 extensions on time. Though the law allows filing of H1 extensions upto 6 months before its expiry, most employers file for extensions only at the last moment. It�s advisable to go for premium processing in such cases, so as to get the approvals on time.
You can apply H1 extn earlier than 6 months. Mine was expiring in Sep 07. I applied on Jan 5th 07. Got 7-8-9 year extn in April.

What do you mean by GC Journey? Do you mean the various USCIS stages (labor, I-140, I-485, ...) in the GC process? If yes, I can do that. However, I am not sure when it will get done. What is your deadline?

Ron has not made prediction specifically about India. Somebody asked Ron about filing I-485 with May 2004 PD without mentioning that (s)he was from India. So Ron probably assumed RoW. We are planning to visit India in Nov 08 after three years. I would be using my AP to return after 4 weeks. My wife is planning to stay there for seven months and plans to return using AP. Based on what I see on this thread, seems like it would be very risky for my wife to use AP to re-enter after a seven month period.
I'm still working on H1B and my wife on H4 ( although she has an EAD, she doesnt work). We have H1B approval valid till March 09. My wife would be re-entering in June 09. I'm in the process of renewing my H1 and H4.
If my wife gets her H4 stamping then she can re-enter in June 09 using H4 visa. I plan to re-enter using AP in Nov 08.
I am also planning to consult my lawyer. Would this work out? Gurus, pls. help
No need to use AP to travel when you are in valid H1 status, and are continuing to work with the GC sponsoring employer. You can use the valid h1 stamp to reenter without any risk to the pending 485

Green Tech, There is a history of posts with buddyinfo alias buddyinusa alias buddyinuk etc etc. This guy has a background of sounding like someone from India, and attacking specific community, pitching one against the other, which it typical terrorist mid-set. The other day he pretended like someone from north India and attacked people from AP. He was also supportive and sympathic towards terrorist who attacked Mumbai on 11/26. Based on that history, I read between the lines whenever he post, and I see it in that light. Others in that category are sab and gcisadawg. I hope it explains where I am coming from.
