I have read Gandhi's autobiography. He clearly explains that he first tried and succeeded using his manthra of passive resistance in South Africa against appalling treatment of Indian workers. They were on 'H1B' in South Africa and were treated worse than stray dogs. Gandhi fought against that and had some success.
So the idea of passive resistance DOES work in a foreign land. We are fighting against injustice. Even H1B folks have some fundamental human rights, whether we are in a foreign country or not.

Recently I returned after a one month trip to India. At DC airport the CBP secondary inspection officer grilled us rough. First he called my wife and asked why did we leave US. She told that since my parents are old and not in good health we visited them. Then he started asking for documents proving it. And told us that without documents he won't let us enter. He went on to say that AP is only on humanitarian basis and unless CBP officer is satisfied with proof they cannot allow AP holder to enter. Finally after convincing him for another 30 min he let us in.
This was a really shocking experience. Are employment based GC's AP supposed to be treated like humanitarian AP? or was the CBP officer over reacting? Gurus please throw some light.

In theory, the idea that a gathering of even 200 people in company's parking lot (Cisco, goolge, microsoft) - IS GREAT.
Immigration Voice has always appreciated efforts of members who get employers involved.
However, I am inclined to believe that company HR will resist such activity on their own premises, especially during business hours or even lunch time. That's because its loss in terms of productivity and distractions for all employees, even those who are US citizens.
BUT...
If someone pulls this off and if there is a gathering to protest green card delays at any of these companies -- Cisco, Oracle, Microsoft, Google, Intel, Amazon...anyone...THEN IV leadership will fly to such an even from wherever they have to fly and attend it at a moments notice (provided your employer allows us in your buildings/premises of course).
Not only that, if you can pull it off, then IV will honor you will a "IMMIGRATION VOICE MEDAL OF HONOR" for doing that. Its a square medal with imprint of GC on one side and EAD card on another side. :):)
So if you can, by all means, pursue that opportunity and email me or Aman on how we can help you do that. Microsoft has 3500 employees in green card wait line in Seattle alone. AC21 applies specifically to the time before you get GC. Even if you do use AC21, you should have the intention to stay with the employer you're with or the future employer (who submits an employment letter attesting they have a permanent job offer which is similar in scope in the LCA and I-140 petition) at the time of GC Approval.
The 90-day timeframe is sufficient to establish intent, as posted earlier.

I had anticipated this and actually converted my I-140 which was filed regular in Feb 2007 to Premium a few days after the June Bulletin and the fact that they terminated I-140 premium processing altogether for Labor Substitutions.
We immediately converted our I-140 (in which we were recapturing our older PD), to premium to avoid any such future USCIS Bolts from the blue.

Just because OP steals office supplies ( his bad habit of shoplifting) he is accusing all immigraants. I take offence to that and when someone asks others to make a choice to marry a hooker or a shoplifter wife as a defence to that shoplifter. How crazy is that?

Because of ppl like the OP and maybe you, we Indians are getting a really bad rep everywhere. (1) Are these steps taken in a sequence?
(2) Does USCIS update the status of our file so that we know where we are i.e whether our file is stuck FBI Name check or FBI Fingerprint Check, etc..
After receiving your I-485 USCIS conducts the following background Checks:
IBIS - Interagency Border Inspection System name check
FBI - FBI Fingerprint Check
FBI - FBI Name Check
IDENT - Automated Biometric Identification System
Other biometric checks - For some cases, USCIS itself conduct comparisons of photograph, finger prints and signatures stored in paper application with ISRS.
You have to clear all these checks (some of them has expiry as well) when your PD becomes current.
Till then keep renewing your EAD / AP. [I think this is the milking cow for USCIS :) ]

EAD Renewal's are eligible for premium processing, so if you really need a renewed EAD to change a job, it's almost comes down to paying an extra $1000 to get it within 15 days. As far as a new EAD goes, USCIS will have to process it within 90 days. Now that they have stopped issuing Interim EAD's , if you go to to the USCIS local office after 90 days of filing the initial EAD applications, they are obligated to come back to you with an answer on why your application has still not been adjudicated. If you do a google search on interim EAD termination, you will find a couple of links about some law firms planning a class action lawsuit to dispute this. This is still not an issue because most people get their EAD's within 90 days, but you can almost bet your bottom dollar that there will be a hue and cry( read class action lawsuit ) if the first time EAD's get delayed more than 90 days because of administrative delays for reasons such as backlog.

We will come to know after 4 or 5 weeks abt our applications (As per USCIS rep)....I think there must be some time limit to file a case...and we dont have a base to file a case until they reject it.
Finally they dont reject application nor they will accept it...
